Terms of Service

These Terms of Service apply to all purchases made through LeMacToppers. By placing an order, you acknowledge that you have read, understood and agreed to the following terms.

Orders & Payment

All orders must be paid for before design work, production or preparation of your order begins.

An order is not considered confirmed until payment has been received.

LeMacToppers reserves the right to decline or cancel an order where necessary. If LeMacToppers cancels an order that has already been paid for, the customer will receive an appropriate refund.

Personalisation

Customers are responsible for ensuring all information supplied when ordering is correct, including names, ages, dates, wording, colours and other personalisation details.

Please carefully check spelling and information before submitting your order.

LeMacToppers is not responsible for errors resulting from incorrect information supplied by the customer.

Handmade Products

LeMacToppers products are handmade, meaning slight variations may occur between products.

Colours may also vary slightly from what is displayed on screen due to different devices, monitors, printing processes and materials.

Minor variations in colour, placement, sizing and finish are part of the handmade nature of our products and are not considered faults.

Designs & Inspiration Images

Inspiration images are welcome and may be used as a guide when creating your order. However, designs created by another business or creator will not be directly copied.

Where possible, LeMacToppers will create a design inspired by the requested theme, colours or overall style while maintaining our own design approach.

Final designs may vary from inspiration images provided.

Proofs & Design Changes

Where a design proof is provided, it is the customer's responsibility to carefully check all details before approval.

Once a design has been approved, changes may not be possible once production has commenced.

If changes are requested after approval or production has begun, additional charges may apply.

Turnaround Times

Turnaround times are estimates and may vary depending on current order volume, product complexity and availability of materials.

Customers are responsible for providing the correct event or required-by date when placing their order and allowing sufficient time for production and delivery.

Where an order requires postage, delivery time is additional to the stated production timeframe.

Shipping

LeMacToppers takes care to package orders appropriately before dispatch.

Once an order has been lodged with the postal or delivery provider, delivery timeframes are outside of our direct control.

Customers are responsible for providing a complete and accurate delivery address.

Product Use

Cake toppers and party decorations are decorative products and are not toys.

Products may contain small parts and should be kept away from babies and young children unless under appropriate adult supervision.

Unless specifically stated otherwise, decorative components should not come into direct contact with food. Only the portion of a product specifically designed for insertion into a cake should be used for that purpose.

Keep all cake toppers and decorations away from open flames, candles and other sources of heat.

Cardstock, acrylic, acetate and other materials used in our products may be flammable or become damaged when exposed to heat.

Never allow candles or flames to come into direct contact with the product.

Customers are responsible for using products safely and appropriately.

Returns, Exchanges & Cancellations

Due to the handmade and personalised nature of our products, returns, exchanges and change-of-mind cancellations are not accepted.

Please refer to our Returns, Exchanges & Cancellations Policy for further information regarding incorrect, faulty or damaged orders.

Intellectual Property

All original LeMacToppers designs, photographs and product images must not be copied, reproduced, resold or used for commercial purposes without permission.

Purchase of a product does not transfer ownership of the underlying design or intellectual property.

Photography & Social Media

LeMacToppers may photograph completed products for use on our website, social media and other promotional material.

Where appropriate, identifying personal information will not be intentionally displayed beyond the personalisation that forms part of the product itself.

If you would prefer that your personalised order is not shared publicly, please contact LeMacToppers.

Limitation of Liability

To the extent permitted by law, LeMacToppers is not responsible for loss or damage resulting from misuse of a product, failure to follow appropriate handling or safety precautions, or circumstances outside our reasonable control.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law that cannot legally be excluded.

Changes to These Terms

LeMacToppers reserves the right to update or amend these Terms of Service when necessary. The Terms applicable to an order will be those in effect at the time the order is placed.
